Net Ban Entangled In Legal Nightmare

Florida’s 18-year-old gillnet ban has been upset by a rural circuit court judge and some netters have already been spreading their meshes in search of large mullet roe profits, although the return of entanglement gear is expected to be ended at any minute.

In a bewildering series of court moves, the Florida Fish and Wildlife Conservation Commission is requesting the First District Court of Appeal in Tallahassee to reinstate a stay, or postponement, of Judge Jackie Fulford’s surprise order while the case is argued over weeks or months ahead.

The stay of the Fulford order would continue the ban of entanglement nets, which was adopted by the voters in 1995 and is credited with restoring countless fish populations.

The netters claim that the net ban is unfair and contradictory. “These are the same old arguments by the same people that have been rejected numerous times in past cases, “ said Florida Sportsman Publisher Karl Wickstrom, who had initiated the constitutional amendment banning gill nets and large seine nets. “The ban is simply a gear restriction that is now common across the country.”

      “We, commercial fisherman, only want to be allowed to fish a net that does not target juvenile fish. We have been arguing this point for years.         BAN IN BACK ON. Thank you. “The First District Court of Appeal has reimposed the automatic stay concerning net fishing in Florida. FWC will enforce the net limitation rules and regulations as defined in the Florida Constitution, administrative code and statute.” Glad to know someone supports TRUE commercial fisherman and the sports fishing in florida right now.

    THATS WHAT YOU DESERVE FOR MAKING US USE THESE 2INCH SEINE NETS ALL THESE YEARS…TO MAKE US GO OUT AND KILL TONS OF BABY MULLET,TROUT,REDFISH AND SNOOK IS JUST PLAIN WRONG…ALL WE WERE ASKING FOR WAS A LARGER MESH SIZE FOR OUR SEINE NETS…THEN WE COULD MAKE A WEEKLY PAYCHECK AND THE SMALLER FISH WOULD LIVE TO ANOTHER DAY…..

    I havent read what the issue is but is it just to increase the holes in the net from 2inch to say 4 or more to avoid killing smaller under sized fish?
